QUESTION: I just rented a house on a month to month verbal agreement with my landlady. I have been in the building trades for a number of years and I noticed that the lock on my back door is old and not locking securely. Should I just fix this and deduct the cost of the new lock from my rent? ANSWER: ORS 90.320 requires the Landlord to maintain the prem- ises in habitable condition and allows for agreements with the Tenant to maintain the pemises. Having properly working locks on entrance doors is part of "habitability." Also, Oregon law permits the Tenant to make repairs under $300 and deduct it from the rent if prior written notice is given to the Landlord describing the repairs and stating the Tenant's intention to deduct this from the rent and giving the Landlord the option of fixing the defect herself. If it looks like there may be a significant number of things that need to be repaired you should write out the list with a written agreement with your Landlady to make these repairs. U.S. Marshals Arrest Man Wanted for Child Pornography On September 17th at 11:30 p.m., John Calvin Hudson III, a 43 year old white male, was arrested by members of the U.S. Marshals Oregon Fugitive Task Force (OFTF) at the Westward Ho Hotel. Hudson is charged with 20 counts of Encouraging Child Sex Abuse in the first degree and 20 counts of Encouraging Child Sex Abuse in the second degree. Hudson has been missing since these charges were filed in Coos County. The charges arise out of an Oregon Department of Justice (DO J) Intemet Crimes Against Children Task Force investigation during which Hudson was found with computers con- taining numerous porno- graphic photos of minors. Based on case profile pro- vided by Oregon DO J, the OFTF acted quickly to locate Hudson in the Bend area. OFTF investigators determined Hudson had just checked into the Westward Ho Hotel and, with the assistance of the Bend Police Department, arrested Hudson who was sitting in his hotel room using a recently purchased comput- er. Investigators also found a large amount of cash and camping gear possibly indi- cating his intent to evade capture. Hudson was booked into the Deschutes County Jail.
